• eCommerce store setup and optimization (Shopify, WordPress/WooCommerce, Amazon, Flipkart, Meesho, and other platforms)
• Meta (Facebook and Instagram) advertising management
• Social media management and content creation
• Product photography and visual content creation
• Growth strategy consulting and implementation

The specific services provided will be outlined in individual service agreements or proposals.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. By using our services, you represent and warrant that you meet these requirements.

4. Account and Access

4.1 Account Ownership

You retain full ownership of all accounts created for your business, including but not limited to:

• Advertising accounts (Meta Business Manager, Google Ads, etc.)
• eCommerce platform accounts
• Social media accounts
• Analytics and tracking accounts

4.2 Access Permissions

To provide our services effectively, you agree to grant GoGrowVia appropriate access to relevant accounts and platforms. You may revoke this access at any time, understanding that it may impact our ability to deliver services.

4.3 Account Security

You are responsible for maintaining the security of your accounts and passwords. GoGrowVia is not liable for any unauthorized access resulting from your failure to maintain account security.

5. Service Terms and Payment

5.1 Service Agreements

Specific services will be detailed in individual proposals or service agreements. These documents will outline:

• Scope of work
• Deliverables and timelines
• Pricing and payment terms
• Performance metrics and reporting

5.2 Payment Terms

Payment terms will be specified in your service agreement. Generally:

• Invoices are due within the specified payment period (typically 7-15 days)
• Late payments may result in service suspension
• Prices are subject to change with 30 days' notice
• All fees are non-refundable unless otherwise stated in your service agreement

5.3 Advertising Spend

For advertising management services, you are responsible for all advertising spend with platforms (Meta, Google, etc.). Our management fees are separate from advertising budgets. You maintain direct billing relationships with advertising platforms.

6. Client Responsibilities

To ensure successful service delivery, you agree to:

• Provide timely access to necessary accounts, materials, and information
• Respond to requests for feedback, approvals, and clarifications within reasonable timeframes
• Ensure all content, products, and services you promote comply with applicable laws and platform policies
• Maintain adequate inventory and fulfillment capabilities for your business
• Communicate changes to your business, products, or objectives promptly

7. Performance and Results

7.1 Best Efforts

GoGrowVia commits to providing services with professional skill, care, and diligence using industry best practices and data-driven strategies.

7.2 Testing and Optimization

Marketing campaigns require testing and optimization periods. Initial results may not reflect long-term performance as we refine strategies based on data.

8. Intellectual Property

8.1 Your Content

You retain all rights to your brand assets, trademarks, product information, and other materials you provide. By engaging our services, you grant us a limited license to use these materials solely for providing services to you.

8.3 Our Work Product

Upon full payment, you receive ownership rights to deliverables created specifically for you (ad creatives, custom graphics, website designs, etc.). We retain the right to use general strategies, processes, and methodologies developed.

8.3 Third-Party Materials

Some work may incorporate third-party elements (stock photos, templates, plugins, etc.). These remain subject to their respective licenses.

9. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the business relationship. This includes but is not limited to business strategies, customer data, financial information, and trade secrets.

10. Term and Termination

10.1 Service Period

Services will continue for the period specified in your service agreement. Many services operate on a monthly basis with provisions for renewal.

10.2 Termination by Client

You may terminate services by providing written notice as specified in your service agreement (typically 30 days). You remain responsible for payment for services rendered through the termination date.

10.3 Termination by GoGrowVia

We reserve the right to terminate services if:

• Payment obligations are not met
• You violate these Terms or service agreements
• Your business engages in illegal or unethical practices
• Continuation of services is impractical or impossible

10.4 Post-Termination

Upon termination, we will provide reasonable transition assistance. You retain all ownership rights to your accounts and data. We will return or destroy confidential information as appropriate.

11. Limitation of Liability

To the maximum extent permitted by law:

• GoGrowVia's total liability for any claims arising from services provided shall not exceed the fees paid by you for services in the three months preceding the claim
• We are not liable for indirect, incidental, consequential, or punitive damages including lost profits, lost revenue, or business interruption
• We are not responsible for platform policy changes, account suspensions by third-party platforms, or force majeure events
• We are not liable for results affected by factors outside our control (market changes, competitor actions, economic conditions, etc.)

You agree to indemnify and hold harmless GoGrowVia, its employees, and contractors from any claims, damages, or expenses arising from:

• Your breach of these Terms or service agreements
• Your violation of any laws or third-party rights
• Content, products, or services you provide or promote
• Your business operations and customer relationships

13. Platform Compliance

You are responsible for ensuring compliance with all policies of third-party platforms (Meta, Google, eCommerce platforms, etc.). We will use best efforts to maintain compliance, but ultimate responsibility rests with you as the account owner.

We warrant that services will be performed in a professional and workmanlike manner consistent with industry standards.

14.2 Disclaimers

Except as expressly stated, services are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

15. Changes to Services and Terms

We reserve the right to modify or discontinue services or update these Terms at any time. Material changes will be communicated via email or through our website. Continued use of services after changes constitutes acceptance of modified Terms.

16. Third-Party Services

Our services may integrate with or rely upon third-party platforms and tools. We are not responsible for the performance, policies, or practices of these third parties. Your use of third-party services is subject to their respective terms and conditions.
